What is Alimony?

If the court orders alimony this means that a payment will be made to you from your spouse. This payment could be monthly or in one lump sum.

If you are receiving regular alimony payments and you die or remarry the alimony will end.

Most fault divorce lawsuits are filed over the issue of alimony. If the judge decides that one spouse is the cause of the divorce, that spouse will normally not be entitled to alimony.

If you have been awarded alimony by the court, and your spouse is not paying it, the court can order your spouse into garnishment, where a portion of their income that is supposed to pay alimony is taken out of their paycheck before they receive it.
